The RxDealz understands that you care about how information about you is used and shared. This Privacy Policy applies to information we collect in relation to your use and access of the www. RxDealz.com, mobile and other applications, or services that post a link to this Privacy Policy (collectively “Sites and Forums”).This Privacy Policy applies to information we collect about:

• Customers; Potential Employees, & Suppliers
By using or accessing any of the Sites and Forums, you agree to our Terms of User Agreement and consent to our collection, use and disclosure practices and other activities as described in this Privacy Policy.

2. WHAT INFORMATION DO WE COLLECT?

Personal information you disclose to us

In Short: We collect personal information that you provide to us.
We collect personal information that you voluntarily provide to us when you register on the Services, express an interest in obtaining information about us or our products and Services, when you participate in activities on the Services (such as by posting messages in our online forums or entering competitions, contests or giveaways) or otherwise when you contact us.

The personal information that we collect depends on the context of your interactions with us and the Services, the choices you make and the products and features you use. The personal information we collect may include the following:

Personal Information Provided by You. We collect names; phone numbers; email addresses; mailing addresses; usernames; passwords; billing addresses; debit/credit card numbers; contact or authentication data; contact preferences; and other similar information.

Payment Data. We may collect data necessary to process your payment if you make purchases, such as your payment instrument number (such as a credit card number), and the security code associated with your payment instrument. All personal information that you provide to us must be true, complete and accurate, and you must notify us of any changes to such personal information.

3. INFORMATION AUTOMATICALLY COLLECTED

In Short: Some information — such as your Internet Protocol (IP) address and/or browser and device characteristics — is collected automatically when you visit our Services.

We automatically collect certain information when you visit, use or navigate the Services. This information does not reveal your specific identity (like your name or contact information) but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you use our Services and other technical information. This information is primarily needed to maintain the security and operation of our Services, and for our internal analytics and reporting purposes.

  • Log and Usage Data. Log and usage data is service-related, diagnostic, usage and performance information our servers automatically collect when you access or use our Services and which we record in log files. The below companies may collect personal information when you interact with our digital property, including IP addresses, digital identifiers, information about your web browsing and app usage and how you interact with our properties and ads for a variety of purpose, such as personalization of offers or advertisements, analytics about how you engage with websites or ads, and other commercial purposes.

4. HOW DO WE USE YOUR INFORMATION?

In Short: We process your information for purposes based on legitimate business interests, the fulfillment of our contract with you, compliance with our legal obligations, and/or your consent.

We use personal information collected via our Services for a variety of business purposes described below. We process your personal information for these purposes in reliance on our legitimate business interests, in order to enter into or perform a contract with you, with your consent, and/or for compliance with our legal obligations. We indicate the specific processing grounds we rely on next to each purpose listed below.

  • To register you as a new customer, including verifying your email address(es) are active and enrolling you in various RxDealz programs;
  • To facilitate, improve, and personalize your online experience;
  • To manage our relationship with you, including notifying you about changes to our Terms of Use Agreement, Privacy Policy or other policies, providing member and customer services, and asking you to leave a review or take a survey;
  • To deliver relevant content and advertisements to you and measure or understand the effectiveness of the advertising or understand the effectiveness of the advertising that we serve to you;
  • To use data analytics to improve our platforms, products/services, marketing, customer relationships and experiences, we analyze audience acquisition, behavior and conversions;
  • To make suggestions and recommendations to you about goods or services that may be of interest to you;
  • To monitor our websites for compliance with our Terms of Use Agreement;
  • Respond to subpoenas or other legal processes and government investigations;
  • To monitor and prevent fraudulent activity and threats;
  • Carry out any other purpose disclosed in this Privacy Policy or at the time you provide your personal information to us;
  • To send you marketing and promotional communications. We and/or our third-party marketing partners may use the personal information you send to us for our marketing purposes, including those offered by third parties; if this is in accordance with your marketing preferences. For example, when expressing an interest in obtaining information about us or our Services, subscribing to marketing or otherwise contacting us, we will collect personal information from you. You can opt-out of our marketing emails at any time (see the “WHAT ARE YOUR PRIVACY RIGHTS” below).
  • Deliver targeted advertising to you. We may use your information to develop and display personalized content and advertising (and work with third parties who do so) tailored to your interests and/or location and to measure its effectiveness.
  • For other business purposes. We may use your information for other business purposes, such as data analysis, identifying usage trends, determining the effectiveness of our promotional campaigns and to evaluate and improve our Services, products, marketing and your experience. We may use and store this information in aggregated and anonymized form so that it is not associated with individual end users and does not include personal information. We will not use identifiable personal information without your consent.

5. DO WE USE COOKIES AND OTHER TRACKING TECHNOLOGIES?

6. MARKETING

We strive to provide you with choices regarding certain personal data uses, particularly around whether you want to receive marketing and advertising offers.

6.1 Promotional offers from us
We may use your Identity, Contact, Technical, Usage, and Profile Data to form a view on what we think you may want or need, or what may be of interest to you. This is how we decide which products, services and offers may be relevant for you.

You will receive marketing communications from us if you have requested information from us, purchased goods or services from us and if you provided us with your details when you participate in a competition, online campaign, or registered for a promotion, in each case, you have not opted out of receiving that marketing.

6.2 Sharing of Information
We may from time to time share your personal data with third parties for marketing and other purposes. This may include sharing of such information with other members of the RxDealz. For example, your personal information may be disclosed:

• In our sole discretion, to aggregated or de-identified information that cannot be reasonably used to identify you with third parties, advertisers and/or business partners for any purpose. Such de-identified and /or aggregated information which does not identify individuals is not subject to this Privacy Policy.
• To any subsidiary and affiliated entities that we control, that control us, or that are under common control with us.
• Whenever you consent to such disclosure.
• To third party businesses offering goods and services via our Sites and Forums.
• When you participate or post in any of our community forums or other public areas of our Sites and Forums. Please note that information you post or disclose through these forums or other public areas may be other users of the Sites and Forums and to the general public, so be careful when deciding to disclose any personal information.
• To participating merchants to process your purchases, in which case your information may be used and disclosed by the merchant (including for marketing purposes) subject to its privacy policy.
• To our third-party service providers who provide services such as website hosting, data analysis, payment processing, information technology and related infrastructure, email delivery, text messaging, auditing, customer relationship and other services.
• In connection with, or during negotiations of, any proposed or actual merger, purchase, sale, assignment, joint venture or transfer of any other type of all or any portion of RxDealz’s business, assets, financing, or stock including in connection with any bankruptcy or similar proceedings.
• To the maximum extent permitted by applicable law, to copyright owners, Internet Service providers, wireless service providers, or law enforcement agencies in our discretion. Such disclosures may be carried out without notice to you.
• To third parties for marketing purposes. This may include third parties whose products or services we believe you may be interested. These third parties may also share your information with others. These third parties may use your information for their own marketing purposes and pursuant to their own policies.
• As we believe to be necessary or appropriate: (a) under applicable law, including laws outside country of residence; (b) to comply with legal process; (c) to respond to requests from public and governmental authorities, including public and governmental authorities outside your country of residence; (d) to protect or defend our legal rights, privacy, safety or property or the rights, privacy, safety or property of our users, affiliates, business partners, employees, agents and contractors (including enforcement of our Terms of Use Agreement, this Privacy Policy or other applicable policies or agreements; and (e) to pursue available remedies or limit the damages that we may sustain.

6.3 Ability to Opt out
You can ask us or third parties to stop sending you marketing messages at any time by logging into the website and checking or unchecking relevant boxes to adjust your marketing preferences or by following the opt-out links on any marketing message sent to you or by contacting us @ask@rxdealz.com.

Even if you opt out of receiving these marketing messages, this will not prevent our collection of personal data provided to us as a result of a product/service purchase, warranty registration, product/service experience or other transactions.

7. IS YOUR INFORMATION TRANSFERRED INTERNATIONALLY?

In Short: We may transfer, store, and process your information in countries other than your own.
Our servers are located in United States, Singapore, and United Kingdom. If you are accessing our Services from outside United States, Singapore, and United Kingdom, please be aware that your information may be transferred to, stored, and processed by us in our facilities and by those third parties with whom we may share your personal information (see “WILL YOUR INFORMATION BE SHARED WITH ANYONE?” above), in and other countries.

If you are a resident in the European Economic Area, then these countries may not necessarily have data protection laws or other similar laws as comprehensive as those in your country. We will however take all necessary measures to protect your personal information in accordance with this privacy notice and applicable law.

European Commission’s Standard Contractual Clauses:

We have implemented measures to protect your personal information, including by using the European Commission’s Standard Contractual Clauses for transfers of personal information between our group companies and between us and our third-party providers. These clauses require all recipients to protect all personal information that they process originating from the EEA in accordance with European data protection laws and regulations. Our Standard Contractual Clauses can be provided upon request. We have implemented similar appropriate safeguards with our third-party service providers and partners and further details can be provided upon request.

8. HOW LONG DO WE KEEP YOUR INFORMATION?

In Short:  We keep your information for as long as necessary to fulfill the purposes outlined in this privacy notice unless otherwise required by law.
We will only keep your personal information for as long as it is necessary for the purposes set out in this privacy notice, unless a longer retention period is required or permitted by law (such as tax, accounting or other legal requirements). No purpose in this notice will require us keeping your personal information for longer than sixty (60) months past the termination of the user’s account.

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize such information, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

We may have to share your personal data with the parties set out below for the purposes set out above. These parties may be:

• Other members and affiliates of the RxDealz who provide us with services to enable us to operate our business. We may also share personal data so that we can improve the RxDealz’s products and services as a whole.
• Third party service providers (acting as processors) who provide IT and system administration services and support.
• Professional advisers (acting as processors or joint controllers) including lawyers, bankers, auditors and insurers who provide consultancy, banking, legal, insurance and accounting services.
• Revenue & Customs, regulators and other authorities (acting as processors or joint controllers) based in the United Kingdom who require reporting of processing activities in certain circumstances.
• Third parties to whom we may choose to sell, transfer, or merge parts of our business or our assets. Alternatively, we may seek to acquire other businesses or merge with them. If a change happens to our business, then the new owners may use your personal data in the same way as set out in this privacy notice.
• We may also share your information at your direction or request, or when you otherwise consent.

We require all third parties to respect the security of your personal data and to treat it in accordance with the law. We do not allow our third-party service providers to use your personal data for their own purposes and only permit them to process your personal data for specified purposes and in accordance with our instructions.

9. DATA SECURITY

We have put in place appropriate security measures to help prevent your personal data from being lost, used or accessed in an unauthorized way, altered, destroyed, or disclosed. In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal data on our instructions and they are subject to a duty of confidentiality.

Although RxDealz uses reasonable efforts to help protect your information, transmission via the Internet is not completely secure and RxDealz cannot guarantee the security of your information collected through our service. Further, you are responsible for protecting your password.

We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

10. DO WE COLLECT INFORMATION FROM MINORS?

In Short: We do not knowingly collect data from or market to children under 18 years of age.
We do not knowingly solicit data from or market to children under 18 years of age. By using the Services, you represent that you are at least 18 or that you are the parent or guardian of such a minor and consent to such minor dependent’s use of the Services. If we learn that personal information from users less than 18 years of age has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our records. 11. WHAT ARE YOUR PRIVACY RIGHTS?

In Short: In some regions, such as the European Economic Area, you have rights that allow you greater access to and control over your personal information. You may review, change, or terminate your account at any time.
In some regions (like the European Economic Area), you have certain rights under applicable data protection laws. These may include the right (i) to request access and obtain a copy of your personal information, (ii) to request rectification or erasure; (iii) to restrict the processing of your personal information; and (iv) if applicable, to data portability. In certain circumstances, you may also have the right to object to the processing of your personal information. To make such a request, please use the contact details provided below. We will consider and act upon any request in accordance with applicable data protection laws.

If we are relying on your consent to process your personal information, you have the right to withdraw your consent at any time. Please note however that this will not affect the lawfulness of the processing before its withdrawal, nor will it affect the processing of your personal information conducted in reliance on lawful processing grounds other than consent.

12. DO CALIFORNIA RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?

In Short:  Yes, if you are a resident of California, you are granted specific rights regarding access to your personal information.
California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. If you are a California resident and would like to make such a request, please submit your request in writing to us using the contact information provided below.

If you are under 18 years of age, reside in California, and have a registered account with a Service, you have the right to request removal of unwanted data that you publicly post on the Services. To request removal of such data, please contact us using the contact information provided below, and include the email address associated with your account and a statement that you reside in California. We will make sure the data is not publicly displayed on the Services, but please be aware that the data may not be completely or comprehensively removed from all our systems (e.g. backups, etc.).

If you are using an authorized agent to exercise your right to opt-out we may deny a request if the authorized agent does not submit proof that they have been validly authorized to act on your behalf.

14. WILL YOUR INFORMATION BE SHARED WITH ANYONE ELSE?

We may disclose your personal information with our service providers pursuant to a written contract between us and each service provider. Each service provider is a for-profit entity that processes the information on our behalf.

We may use your personal information for our own business purposes, such as for undertaking internal research for technological development and demonstration. This is not considered to be “selling” of your personal data.

RxDealz has disclosed the following categories of personal information to third parties for a business or commercial purpose in the preceding twelve (12) months:

  • Category B. Personal information, as defined in the California Customer Records law, such as your name, contact information, education, employment, employment history and financial information.

15. YOUR RIGHTS WITH RESPECT TO YOUR PERSONAL DATAY

Right to request deletion of the data – Request to delete

You can ask for the deletion of your personal information. If you ask us to delete your personal information, we will respect your request and delete your personal information, subject to certain exceptions provided by law, such as (but not limited to) the exercise by another consumer of his or her right to free speech, our compliance requirements resulting from a legal obligation or any processing that may be required to protect against illegal activities.

Right to be informed – Request to know
Depending on the circumstances, you have a right to know:

  • whether we collect and use your personal information;
  • the categories of personal information that we collect;
  • the purposes for which the collected personal information is used;
  • whether we sell your personal information to third parties;

In accordance with applicable law, we are not obligated to provide or delete consumer information that is de-identified in response to a consumer request or to re-identify individual data to verify a consumer request.

  • Verification process

Upon receiving your request, we will need to verify your identity to determine you are the same person about whom we have the information in our system. These verification efforts require us to ask you to provide information so that we can match it with information you have previously provided us. For instance, depending on the type of request you submit, we may ask you to provide certain information so that we can match the information you provide with the information we already have on file, or we may contact you through a communication method (e.g. phone or email) that you have previously provided to us. We may also use other verification methods as the circumstances dictate.

We will only use personal information provided in your request to verify your identity or authority to make the request. To the extent possible, we will avoid requesting additional information from you for the purposes of verification. If, however, if we cannot verify your identity from the information already maintained by us, we may request that you provide additional information for the purposes of verifying your identity, and for security or fraud-prevention purposes. We will delete such additionally provided information as soon as we finish verifying you.

Other privacy rights

  • you may object to the processing of your personal data
  • you may request correction of your personal data if it is incorrect or no longer relevant, or ask to restrict the processing of the data
  • you can designate an authorized agent to make a request under the CCPA on your behalf. We may deny a request from an authorized agent that does not submit proof that they have been validly authorized to act on your behalf in accordance with the CCPA.
  • you may request to opt-out from future selling of your personal information to third parties. Upon receiving a request to opt-out, we will act upon the request as soon as feasibly possible, but no later than 15 days from the date of the request submission.

If we make material changes to this privacy notice, we may notify you either by prominently posting a notice of such changes or by directly sending you a notification. We encourage you to review this privacy notice frequently to be informed of how we are protecting your information.
